ROLEAR - Automatizações, Estudos e Representações S.A. is a public limited company with its head office at Parque Rolear, Sítio do Areal Gordo in Faro, legal person number 500 883 750, henceforth referred to as ROLEAR. The company’s business purpose is to undertake engineering studies and projects and execute automatism processes for industrial equipment; equipment wholesale for electricity, electronics, electro-mechanics, mechanics, AVAC, solar energy, solar thermal, wind, gas and similar; marketing and distribution of piped and bottled gas, and lubricants; purchase and sale of energy in the form of electricity, natural gas and other; studies, projects, installation and maintenance of piped gas networks; civil construction and public works, administration and management of movable and immovable goods; rental, swap, purchase and sale of real estate and resale of property obtained for such a purpose.
ROLEAR markets its products and services through its brands Rolegás, Rolear Viva, Rolear Mais and UPLive.
ROLEAR is committed to protecting the personal data of its clients and website users in all situations in which such data is processed and it has thus drafted the present policy, which is based on the company’s underlying commitment to respect personal data protection rules.
WHY IS THERE A NEED FOR THIS PERSONAL DATA PROTECTION POLICY?
The purpose of this policy is to make clients and users aware of the general rules for processing personal data that is collected and processed in strict respect and compliance with applicable personal data protection legislation, namely Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 ("GDPR").

This Data protection Policy applies exclusively to the collection and processing of personal data that ROLEAR is responsible for processing within the scope of the services and products made available to its clients and users and in all situations in which such processing takes place, namely in terms of the contractual relationship that has been established and within the scope of the usage of its websites.

Personal data processing involves an operation or group of operations conducted involving personal data or groups of personal data through automated or non-automated means, namely collection, recording, organization, structuring, preservation, adaptation, recovery, consultation, use, disclosure, diffusion, comparison, interconnection, limitation, deletion or destruction.
WHO IS RESPONSIBLE FOR DATA PROCESSING?
The entity responsible for processing personal data is ROLEAR - Automatizações, Estudos e Representações S.A., which determines the categories of the collected data, what it is used for and the way in which it is processed.
WHAT TYPE OF DATA IS PROCESSED?
ROLEAR collects and processes the personal data that is necessary for performing its business activity and managing its websites, namely:

DATA COLLECTED REGARDING GAS AND ELECTRICITY CLIENTS:
In addition to the aforementioned data, ROLEAR collects the following data when dealing with gas and/or electricity clients:
• subscribed demand • rate • range • delivery point code (DPC) • universal installation code for natural gas (UIC) • type of consumption location • land cadastre number of the consumption location • local installation code (LIC)• owner/tenant• number of inhabitants/occupants of the consumption location • period of construction • type • type of occupation • usable floor area • NG installation • date of the last gas inspection • SIC • number of meters• number of buildings • number of floors • number of associated independent units • form of condominium administration • information regarding the client’s electrical equipment • meter number • information on gas burning equipment • previous seller • history of readings • contract number • client number • information on eligibility to obtain the social tariff
WHEN AND HOW DO WE COLLECT YOUR PERSONAL DATA?
ROLEAR collects your personal data through direct contact with the Rolear outlets, by telephone, e-mail, mail, via website registration and/or newsletters, always guaranteeing, when necessary, prior consent for processing given by the owner of the personal data.
Some personal data is indispensable to executing the contract and in the event of a lack of or insufficient data, ROLEAR will not be able to provide the requested product or service.
WHY IS PERSONAL DATA PROCESSED AND WHO RECEIVES THE DATA?
Notwithstanding compliance with legal obligations that require communication with police, judicial, tax and regulatory authorities, the personal data that is collected by ROLEAR is used to manage commercial and administrative relations with its clients, in order to be able to allow the company to supply and make its products and services available:
ROLEAR processes its clients’ personal data in order to execute and sign contracts in view of complying with legal obligations, when pursuing its legitimate interests, or when it has obtained consent.
Express consent is required for ROLEAR to promote information and marketing actions to its clients and/or website users regarding the products and services that it markets, including any new ones that may appear on the market, in order to keep clients and users updated or provide them with any other information relevant to the business area.
Personal data that is collected and/or transmitted by job applicants shall be used in future contacts in order to select/hire employees/workers.
FOR HOW LONG DO WE KEEP YOUR PERSONAL DATA?
Data shall be stored and kept only for the amount of time that is deemed sufficient and necessary for the purposes that underlie its collection and processing, after which, the data shall be eliminated, notwithstanding the right to elimination and legal provisions that require maintaining personal data for a longer minimum period of time. In terms of newsletter registrations, data shall be stored and kept for the duration of the registration or subscription to the newsletter.
Personal data that is collected and/or transmitted by job applicants shall be stored and kept for a period of 1 (one) year, counted as of the date of its collection/transmission, after which it shall be deleted.
WHAT ARE YOUR RIGHTS AS THE OWNER OF THE DATA?
RIGHTS OF ACCESS, RECTIFICATION, UPDATING, LIMITATION, ELIMINATION, OPPOSITION AND CONSENT WITHDRAWAL:
As owners of the personal data, clients and website users are guaranteed at any time the right to access, rectify, update, limit and eliminate their personal data, along with the right to oppose use of the data for commercial purposes and to withdraw consent, without compromising the legality of the processing conducted within the scope of that consent.
RIGHT TO PORTABILITY OF DATA:
The owner of the data is entitled to receive the personal data that has been supplied whenever the processing has been performed via automatic means and when it is based on a contract or on his or her consent. Upon exercising the right to portability of data, the owner is also entitled to have his or her data transmitted directly between the parties responsible for the processing, whenever technically possible.
HOW CAN I ACCESS, RECTIFY, UPDATE, LIMIT, ELIMINATE, OPPOSE THE PROCESSING OF PERSONAL DATA OR WITHDRAW CONSENT?

HOW CAN I MAKE A COMPLAINT?
Notwithstanding the ability to submit complaints directly to ROLEAR via the contact information made available for that purpose, the client/user can make a complaint directly to the Control Authority, which is the National Data Protection Commission (NDPC), using the contact information made available by the latter entity for such a purpose.
WHAT MEASURES HAVE BEEN ADOPTED BY ROLEAR TO ENSURE THE SECURITY OF PERSONAL DATA ?
ROLEAR guarantees the security of the personal data that is made available, by adopting various and advanced security measures, both technical and organizational, in order to protect personal data from its diffusion, loss, undue use, alteration, processing or unauthorized access, as well as against any other form of illegal processing, namely placing the servers in a specific physical space with limited access and with 24 (twenty-four) hour surveillance, 7 (seven) days per week. Only persons duly authorized through logical clearance tools can access the servers.
COMMUNICATION WITH THIRD PARTIES:
ROLEAR works with third parties to perform certain services related to maintenance and technical support and these third parties may have access to some of the personal data of its clients, namely the data necessary for support purposes.
ROLEAR ensures that the entities that have access to the data are credible and offer a high degree of protection guarantees, and only data that is strictly necessary for supplying the contracted service is transmitted to them; however, ROLEAR is still responsible for the data that is supplied.
ROLEAR shall also transmit data to third parties as part of investigations, inquiries and legal and/or administrative proceedings or any other proceedings of a similar nature, provided such is enforced by a judicial and/or administrative order.
